Bookpackfly USER AGREEMENT

To Whom the AGREEMENT may Concern:

The agreement ("user agreement") incorporates the terms and conditions for Bookpackfly and its affiliated companies ("Bookpackfly") to provide services to the individual(s) ("the User") intending to buy or inquire about any of Bookpackfly's products and/or services by using Bookpackfly's websites or using any other customer interface channels of Bookpackfly, including its salespeople, offices, call centers, advertisements, information campaigns, etc.

Individually referred to as "parties" to the agreement and together referred to as "parties," are User and Bookpackfly.

THE RESPONSIBILITY OF THE USER TO ACKNOWLEDGE THIS AGREEMENT

When using Bookpackfly services, Users are presumed to have read, understood, and expressly accepted the terms and conditions of this agreement, which are legally binding on the User and control any requested transaction or provision of services by Bookpackfly. All User and/or Bookpackfly rights and obligations with regard to any services that Bookpackfly will offer are confined to the terms of this agreement.

Bookpackfly retains the right to permanently or temporarily block access to any or all of its websites, other sales channels, and related services, or any part thereof, at any time and without prior notice, for general maintenance or any reason whatsoever.

There are additional terms of service (TOS) that are specific to the services and goods offered by Bookpackfly, such as airline tickets, MICE, buses, trains, vacation packages, etc. In the case of a discrepancy between such TOS and this Agreement, the terms of this Agreement shall take precedence. Such TOS will be supplied or updated by Bookpackfly and will be deemed to be a part of this Agreement. The User must read and agree to the applicable TOS before using the service or purchasing the product.

Additionally, the Service Provider may offer its own terms and regulations for certain features, promotions, or the operational regulations and standards that apply to each Service (for example, flights, hotel reservations, packages, etc.).

The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Provider's fare rules, contract of carriage, or other rules.

Bookpackfly Services are made available to users on the condition that they agree to all of the terms, conditions, and notices in this agreement and the TOS, as updated from time to time. To dispel any confusion, it is made clear that using the Services by the User is equivalent to acknowledging and accepting this Agreement and the TOS on their part. The User shall not use the Bookpackfly Services if they do not agree with any of the terms, conditions, or notices.

If any of the terms, conditions or notices in this document conflict with the Additional Terms or any other terms and policies in any other document published by Bookpackfly, the terms in this document shall take precedence.

INFORMATION FROM THIRD-PARTY ACCOUNTS

By utilizing Bookpackfly's websites' Account Access service, the user grants permission to Bookpackfly and its agents to access third-party websites, such as banks and other payment gateways, that are chosen by or on their behalf for the purpose of retrieving the desired information.

The User will select a password at registration and is in charge of protecting the security of both the password and the account.

All actions taken using the User's password or account are solely their responsibility. It is the User's responsibility to report any unauthorized use of their password or account, as well as any other security breach, to Bookpackfly as soon as possible in writing. Bookpackfly won't be responsible for any losses you could sustainWhether with or without his knowledge, illegal use of the User's password or account will result in liability to him. The User must never use another person's password.

PAYMENT OF FEES

Bookpackfly retains the right to levy transaction fees based on specific completed transactions made utilising the services, as well as listing fees for particular listings. Additionally, Bookpackfly retains the right to periodically change all costs without prior notification.

All costs associated with using the services, including but not limited to costs, fees, duties, taxes, and assessments, shall be entirely borne by the User.

If Bookpackfly undercharges for a listing, service, transaction fee, or any other cost or service due to a technical issue or other. It retains the right, in its sole discretion, to deduct, charge, or claim the remaining balance after the transaction.

We will conduct the refund and let you know about it in the unlikely event that the reservation is not confirmed for any reason. Bookpackfly is under no duty to compensate for or replace the unconfirmed booking in any way. All additional reservations made after then will be handled as separate transactions and not be linked to the original, unreserved reservation.

Within 90 days after the date of departure for the air ticket and/or the date of check-in for the hotel reservation, the User must submit a refund request to Bookpackfly for any unused or "no show" air or hotel reservations.

Any necessary reimbursements would be processed in accordance with the established rules of the airlines, hotels, and Bookpackfly as applicable. Any requests filed after the aforementioned 90-day period would not be eligible for a refund, and any unclaimed funds for such unused or "no-show" hotel or air reservations would be declared forfeited.

CONFIDENTIALITY

Any information designated by Bookpackfly as confidential must be kept private by the user and must not be shared unless required by law or is necessary to fulfil the duties of both parties under this agreement.

USAGE OF THE USER'S MOBILE NUMBER BY Bookpackfly

Bookpackfly may send an itinerary confirmation, a booking confirmation, and other information. Bookpackfly may contact the User by voice call, SMS, or email if the User was unable to complete the booking for any reason, in order to find out the User's preference for doing so and to assist the User in doing so. The User hereby unconditionally agrees that such communications by Bookpackfly through SMS and/or phone call are (a) made at the User's request and permission, and (b) are "transactional" and not "unsolicited commercial communication."

The User agrees to hold Bookpackfly harmless from any losses or expenses incurred by Bookpackfly or another authority as a result of any incorrect complaints the User files on Bookpackfly regarding the notifications listed above, or as a result of the User providing a wrong phone number or email address for any reason.

USER'S RESPONSIBILITY

Only the transactions that are carried out by the User through Bookpackfly are subject to Bookpackfly's liability. It is not the responsibility of Bookpackfly to determine if a transaction is lawful and valid under the laws of the user's country, or to screen, censor, or otherwise control it.

The User guarantees that when using the services, they will adhere to all extra rules and regulations, as they may be updated from time to time. The User further guarantees that they will abide by all laws and rules governing the usage of the services with regard to the appropriate jurisdiction for each transaction.

The User affirms and confirms that they are of legal age to enter into a contract and that they are not otherwise ineligible to use the Services under the laws of Singapore or other applicable laws.

ON Bookpackfly OR LINKED WEBSITES, ADVERTISERS

Bookpackfly disclaims all liability for any errors, inaccuracies, or statements on any of its pages, as well as those of any connected websites. Bookpackfly makes no endorsements of any kind regarding any advertising on our website. Before placing any reliance on any information, the Users are urged to independently check its correctness.

The linked sites are not under Bookpackfly's control, and Bookpackfly is not liable for their contents, any links contained in them, changes, or updates to those sites. As a courtesy, Bookpackfly is just offering these links to Users; the inclusion of any link does not imply endorsement of the linked website by Bookpackfly.

INSURANCE

Unless specifically stated by Bookpackfly in any particular service or deliverable, getting adequate insurance protection is the client's responsibility or option. Or one of the users, and Bookpackfly disclaims all liability for claims resulting from such events.

Any insurance offered as a component of a service or product by Bookpackfly will be subject to the terms and conditions of the insurer. For any claims or disputes, the User should speak with the insurance provider directly. Bookpackfly will not make any stated or implied promises about the insurance provider's willingness to accept claims.

MAJOR FORCED CIRCUMSTANCES

The user acknowledges that there may be exceptional situations in which service providers, such as airlines, hotels, and the relevant transportation companies, are unable to honor confirmed bookings for a variety of reasons, including weather conditions, labor unrest, insolvency, business needs, political decisions, operational and technical difficulties, changes in the flight path, etc. When given advance notice of potential booking dishonor situations, Bookpackfly will use reasonable attempts to offer clients comparable alternatives or, if supported and refunded by the relevant service providers, will refund the booking money less reasonable service fees. The user acknowledges that, as an agent for facilitating the booking services, Bookpackfly shall not be liable for any such events and that consumers shall deal directly with the relevant service provider for any additional resolutions and refunds.

The User acknowledges that services pledged earlier may not be performed or may require material modification in the event of any technical or another failure in Bookpackfly.

When this occurs, Bookpackfly will fully release itself from any and all obligations related to the non-provision of services or other shortcomings by returning the whole money received from the client for using those services, less any applicable cancellation, refund, or other fees. Any additional obligations that may arise are the User's responsibility.

Bookpackfly is not responsible for delays, inability to perform, or nonperformance of its obligations in whole or in part due to any factors beyond its reasonable control, such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism, or other similar factors, as well as issues with airlines, trains, buses, hotels, or transporters. The impacted user will be quickly informed as soon as the circumstances allow.

Without limiting the aforementioned, Bookpackfly's maximum liability for any services supplied on the site, under all circumstances, shall be limited to a refund of the whole amount paid by the client for those services, less any applicable cancellation, refund, or other fees. Any loss, damage, or additional cost over and above what Bookpackfly charges for its services is not, under any circumstances, including in the liability.

No matter what, neither Bookpackfly nor any of its suppliers will ever be held responsible for any direct, indirect, punitive, incidental, special, consequential, or other damages, including but not limited to damages for loss of usage, data, or earnings resulting from or associated in any way with using or utilizing the Bookpackfly website(s) or any other channel. In addition, neither Bookpackfly nor any of its affiliates shall have any liability for any delay in, inability to use, provision of, or failure to provide services; or for any information, software, products, services, and related graphics obtained through, or otherwise arising from, the use of, the Bookpackfly website(s), whether in contract, tort, negligence, strict liability, or other legal theory.

Bookpackfly disclaims all liability for any mistakes, omissions, or statements made on any of its pages, links, or linked website pages.

SAFETY OF DOWNLOADED DATA

The User acknowledges and agrees that any material and/or data downloaded or otherwise acquired through the use of the Service is done at the User's own initiative and risk and that they alone are responsible for any harm to their computer systems or data loss resulting from such material and/or data downloads.

Bookpackfly will nevertheless always use its best efforts to guarantee that the information on its websites or other information channels is free of any viruses or other malware of this nature.

CUSTOMER COMMENTS AND SOLICITATION:

The User is aware that Bookpackfly offers a variety of services, including hotel reservations, vehicle rentals, and vacations, and would like to learn more about them in order to improve their travel experience.

The User now expressly grants Bookpackfly permission to occasionally contact the User via direct mailers, e-mailers, phone calls, short messaging services (SMS), or any other means with offers on different services it provides. If a customer decides they do not want to be contacted, they can inform the relevant service provider of their choices or write to Bookpackfly for particular exclusion at [email protected]. Customers are recommended to read and comprehend Bookpackfly's privacy statement on its website to see how the company contacts, solicits and shares user information.

CONSTITUTIONAL RIGHTS

The User may receive content from Bookpackfly such as audio, visual, graphic, or other materials found in sponsor commercials or information. Copyright, trademark, or other intellectual property rights and laws may protect this content.

The User is not permitted to reproduce, transfer, or create derivative works of this material without specific permission from Bookpackfly and may only use it as expressly authorized by Bookpackfly.

VISA RESPONSIBILITIES OF THE USER

Bookpackfly makes travel reservations, which are subject to any applicable visa requirements that must be met by the particular traveler. In addition to not being able to fly due to such Visa restrictions, Bookpackfly is also not obligated to offer refunds for any reservations that were not used for any such reason.

LIMITATIONS ON PERSONAL AND NON-COMMERCIAL USE

The Bookpackfly services are for the User's personal, non-commercial use unless otherwise stated.

Without the express written consent of Bookpackfly, the User is not permitted to change, duplicate, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Bookpackfly website(s).

INDEMNIFICATION

The User agrees to hold Bookpackfly, its affiliates, their websites, and their respective legal successors and assigns harmless from and against any and all losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Bookpackfly, its affiliates, partner websites, and their respective legal successors and assigns, any violation or failure to uphold any representation, guarantee, covenant, or agreement made or duty owed by the User under this Agreement.

Any violation of any country-specific laws or general codes of conduct shall be the sole and exclusive responsibility of the user, and Bookpackfly shall have no liability in connection therewith.

Right to decline

Bookpackfly retains the right, in its sole discretion, to refuse any customer order without providing a justification. Any agreement for Bookpackfly to offer a service is not finalized until the customer has paid in full and Bookpackfly has accepted it.

Without limiting Bookpackfly's other legal options under this Agreement, the TOS, or

If a user violates this agreement, the TOS, or any other documents it incorporates by reference, Bookpackfly may limit the user's activity, terminate the user's listing, warn other users of the user's behavior, immediately suspend or terminate the user's registration, and/or refuse to grant the user access to the website, as permitted by applicable law. Bookpackfly thinks that the user's conduct may violate the rights of third parties, violate the law, or in some other way put the user, other website users, and/or Bookpackfly in jeopardy.

Bookpackfly reserves the right to reactivate suspended users at any moment.Once the user has been indefinitely suspended, they are not permitted to register with Bookpackfly, make any attempt to register or use the service in any way until Bookpackfly has restored them.

Despite the aforementioned, Bookpackfly reserves the right to recover any amounts due and owing by the user to Bookpackfly and/or the service provider and to take strict legal action as Bookpackfly deems necessary if the user violates this agreement, the TOS, or the documents it incorporates by reference.

Bookpackfly has the right to cancel reservations if the user provides inaccurate information.

When requesting any services under this Agreement, the User expressly agrees to supply Bookpackfly with only true and accurate information and to never mislead the truth in any way. Any breach on the part of the User will invalidate this agreement and prevent the User from using Bookpackfly's services.

Bookpackfly shall have the unrestricted right to take any action against the User(s), including but not limited to canceling the bookings, at its sole discretion if it finds out or has reason to believe at any time during or after receiving a request for services from the User that the request is either unauthorized or the information provided by the User or any of them is incorrect or that any fact has been misrepresented by him. As a result of such cancellation of bookings or services, Bookpackfly shall not be accountable or responsible for any loss or damage that may be suffered by the User or any of them.

Without any reservation, the User releases Bookpackfly from any such claim or obligation and agrees not to hold Bookpackfly liable for any loss or damage resulting from actions taken by Bookpackfly to protect its own interests and the interests of its real clients. Additionally, Bookpackfly could refuse or cancel any reservations due to possible fraud.

GENDER AND INTERPRETATION NUMBER

Both the singular and plural forms of the terminology defined herein shall be equally subject to the rules and conditions herein. Whenever the situation may call for any pronoun must be followed by the appropriate neuter, feminine, and masculine forms. The phrase "without limitation" shall be interpreted to follow the words "including," "includes," and "including." The terms "herein," "hereof," "hereto," "hereunder," and words of like significance refer to this agreement as a whole unless the context clearly dictates otherwise.

SEVERABILITY

Any provision of this contract that is found to be invalid or unenforceable in whole or in part shall only apply to that provision or that portion of it; the remaining portion of that provision and the remaining terms of this contract shall remain in full force and effect.

HEADINGS

The inclusion of the headings and subheadings herein is merely for convenience and identification purposes; they are not meant to describe, interpret, define, or limit in any way the scope, extent, or intent of this agreement, its terms, and conditions, notices, or the User's right to use this website in accordance with the provisions contained herein or in any other section or page of the Bookpackfly Websites or those of its affiliate websites.

These terms shall take precedence over any Additional Terms or other terms and policies found on any specific Bookpackfly website if any of the terms, conditions, or notices contained herein conflict with those terms or policies.

RELATIONSHIP

None of the terms and conditions of any contract, notices, or rights to use this website. No party shall have the power to bind or be deemed the agent of the other in any way with respect to any information provided by the User herein or in any other section or page of the Bookpackfly Websites or its partner websites, which shall be deemed to constitute a partnership between the User and Bookpackfly.

JURISDICTION

USER RESPONSIBILITIES VIS-À-VIS THE CONTRACT

Use of the services is the exclusive responsibility of the User, who expressly acknowledges this. Bookpackfly shall not be liable in any way for any aspect of the standards of services rendered by the service providers to the extent that it only serves as a booking agent on their behalf. Bookpackfly is not responsible under any circumstances for the services rendered by the service provider. The offerings are made available "as is" and "as available." There may be feature changes in Bookpackfly and alter the functioning of the services at any time and without prior notice, at their sole discretion. Excluding the implied warranty of merchantability, fitness for a specific purpose, and non-infringement, Bookpackfly expressly disclaims all guarantees of any kind, whether stated or implied. No oral or written information that a user gains from Bookpackfly or through the services will unless clearly stated otherwise in this document or the terms and conditions of the services, generate any warranty.
